Retailers who dumped romaine lettuce on the advice of the United States Centres for Disease Control are learning that their insurance will not cover these losses.

There was no recall, only the broad warning to dump all romaine lettuce because at that point the government had not identified the source. Most insurance policies cover recalls.

The Public Health Agency of Canada also advised people to dump romaine lettuce.

Michael Droke, a partner at the international law firm Dorsey & Whitney that specializes in these types of issues, says companies ought to check their insurance policies and find out whether it’s possible to broaden coverage beyond recalls.
